Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Nick Tung ("we", "us", or "our"), operating at drnicktung.com (the "Site").

By accessing or using the Site, engaging our consulting services, or subscribing to our mailing list, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

We reserve the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.

We offer the following services through the Site:

• AI Solutions Consulting — custom AI employee deployments and automation systems for businesses, scoped and quoted individually
• Free Content — publicly available articles, resources, and guides published on the Site
• Email Newsletter — a free mailing list for updates, insights, and announcements

AI Solutions engagements are subject to a separate written agreement or proposal between you and Nick Tung. Pricing, scope, delivery timelines, and payment terms will be stated in that agreement. These Terms apply in addition to any such agreement.

We reserve the right to decline any engagement at our discretion. Consulting engagements are provided on a retainer or project basis as agreed in writing.

The Site uses passwordless magic link authentication via email. You are responsible for maintaining the security of the email account associated with your login. We are not liable for any loss arising from unauthorised access to your account through your email.

You agree to provide accurate information when signing up and to notify us immediately if you suspect unauthorised use of your account.

All content on the Site — including but not limited to articles, frameworks, templates, case studies, AI tools, branding, and design — is the intellectual property of Nick Tung and is protected under applicable Singapore copyright law.

You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from the Site without our prior written consent. Personal, non-commercial use for reference is permitted provided you credit the source.

You agree not to:

• Use the Site for any unlawful purpose or in violation of Singapore law
• Attempt to gain unauthorised access to any part of the Site or its backend systems
• Scrape, harvest, or systematically extract content from the Site
• Impersonate any person or entity, or misrepresent your affiliation
• Transmit any malicious code, spam, or harmful content
• Resell, reproduce, or redistribute our content or templates to third parties

We reserve the right to terminate access for any user who violates these Terms.

The Site integrates third-party services including Supabase (authentication and database), Resend (email), and Vercel (hosting). Your use of these services through the Site is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

Content on the Site, including AI consulting frameworks and articles, is for informational and educational purposes only. Nothing on the Site constitutes professional financial, legal, or medical advice. You should seek independent professional advice before acting on any information provided.

To the fullest extent permitted by Singapore law, Nick Tung shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, even if advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount you have paid us in the 3 months preceding the claim.

These Terms are governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved by good-faith negotiation between the parties.

If unresolved, disputes shall be submitted to the non-exclusive jurisdiction of the courts of Singapore. You may also consider mediation through the Singapore Mediation Centre as an alternative to litigation.

Nothing in these Terms is intended to exclude, restrict, or modify your rights under the Consumer Protection (Fair Trading) Act (Cap. 52A) of Singapore or any other statutory rights you may have as a consumer.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
